Present petition has been filed under Article 226 of Constitution of India read with Section 482 of Code of Criminal Procedure for issuance of a writ of Habeas Corpus with a direction to respondents No. 1 to 3 to produce Sonia wife of the petitioner who has been illegally detained by respondents No. 4 and 5. 2.

Notice was issued in this matter.

Learned counsel for the petitioner submits that the marriage between the petitioner and Sonia was solemnized at Arya Samaj Vedic Sanskar Trust, Rajender Market, Tis Hazari, Delhi on 14.05.2016. Copy of the marriage certificate has been annexed along with the petition. In support of proof of age of Sonia, Class X certificate of Sonia has also been placed on record.

Sonia has been produced in court by the concerned SHO. Sonia submits that she has married Parveen Kumar out of her own free will without any pressure, fear or coercion. She further submits that she would like to stay with the petitioner.

Having regard to the submissions made and stand taken by Sonia, we allow the petition. Sonia would be free to join the company of her husband. Uncle of the petitioner (Elder brother of father of the petitioner) is present in Court and submits that their family has accepted the marriage.

Petitioner also prays for police protection for himself and his family members and submits that the family members of the Sonia are continuously extending threats to them. We direct the SHO, Police Station - Najafgarh to provide necessary protection to the petitioner and his family members.
