% 18.05.2017 CS(COMM) 229/2017, I.A. No.3823/2017 (under Order XXXIX Rules 1 & 2 of the Code) & I.A. No.3824/2017 (under Order XXVI Rule 9 of the Code) Parties have settled their disputes. Learned counsel for the defendant under instructions from the defendant present in Court states that he is ready to suffer a decree in terms of prayers a & b of the plaint. In terms of prayer 'd', he will deliver the impugned goods of the plaintiff who may destroy the same.

Learned counsel for the defendant additionally points out that this application which he has filed before the trademark authorities already stands withdrawn and no action shall be taken qua this application.

Suit of the plaintiff stands decreed in terms of prayers 'a', 'b' and 'd'.
