% 03.03.2016 CM Appln. No.4808/2016 This application has been moved by petitioner seeking refund of Rs.2,89,740/- that had been deposited with the Registrar General of this Court in terms of the orders passed on 05.10.2010, along any interest that may have accrued thereon.

Notice in this application was directed to issue on 09.02.2016 returnable today.

Office reports that both the respondents have been served. However, there is no appearance on behalf of the respondents. The petition came to be disposed off by this Court on 08.03.2013 with a direction to the petitioners to pay a sum of Rs.16,50,000/- in full and final settlement of all the claims of the respondents against the petitioner school.

The said amount is stated to have been duly paid vide cheque No.018370, dated 09.04.2013 and respondent No.1 is stated to have also given a receipt dated 16.04.2013 acknowledging the said payment in full and final settlement. A copy of the receipt is annexed to this application. Under the circumstances, and as prayed, the Registry is directed to refund the amount of R.2,89,740/- along with any interest that may have accrued thereon, to the petitioner / applicant within three weeks from today, after complying with all the necessary formalities. The application is disposed off.
