O R D E R

% 05.02.2018 After some arguments, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and instead move a review application before the Rent Controller explaining the default and seeking restoration of the application for leave to defend. The petition is dismissed as withdrawn with liberty, as prayed, granted. The review application, subject to its consideration on merits, may be filed within four weeks hereof.

Needless to add, the Rent Controller will consider such an application in accordance with law.

The counsel for the respondent undertakes that he would not execute the eviction order for four weeks, as is the time granted to file review application.
