Petitioner impugns order dated 07.04.2016 passed by the Trial Court dismissing the application of the petitioner under Order 12 Rule 6 CPC.

Learned counsel for the petitioner submits that the suit is at the stage of defendant/respondent evidence and as per his instructions, evidence is likely to be concluded today itself. 3.

Learned counsel for the petitioner, under instructions, submits that in case directions are issued to the Trial Court for expeditious disposal of the suit, he shall not press his present petition. 4.

In view of the above, petition is dismissed as withdrawn. C.R.P. 154/2018

However, the Trial Court is directed to expedite the proceedings and endeavour to decide the suit on merits within a period of 3 months from today.
