% 01.02.2019 We have heard learned counsel for the parties and are of the opinion that in the circumstances of the case, the only relief that can be feasibly given is to permit pre-deposit amounts towards hearing of the appeal against the Order-in-Original No.34/COMMR/ST/JBP/2017 dated 28.03.2017 to be deposited on or before 01.04.2019. In case the petitioner complies with this direction, the CESTAT shall entertain the petitioner's appeal and after duly verifying compliance with this order, hear and dispose it of on merits.
The writ petition and the pending application are disposed of in the above terms.
