% 11.02.2016 Ms. Rakhi Ray, learned counsel appearing for the plaintiff seeks discharge. Mr. S.K. Mishra, Adv. appears for the plaintiff and states that the vakalatnama shall be filed within a week.

I have been informed by learned counsel for the defendant that O.A 16/2013, which was an appeal against the order dated October 18, 2012 of the learned Joint Registrar, has been dismissed by this Court vide order dated September 9, 2015 in CS (OS) 2255/2009. In view of the order, dismissing the O.A, there is no impediment in transferring the suit to the concerned District Court.

The plaintiff has filed the suit for specific performance. The valuation of the suit is Rs. 26,22,964/-.

In view of Notification No. 27187/DHC/Orgl. dated 24th November,

2015 & in exercise of power conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, (Act 23 of 2015), which came into force with effect from 26th October, 2015 vide Notification No. F.No.L19015/04/2012-Jus dated 26th October, 2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs published in Gazette of India Extraordinary, Part II, Section 3 Sub-Section (ii), the present matter is liable to be transferred to the learned District & Sessions Judge, New Delhi District, Patiala House Court, Delhi. Accordingly, the parties to appear before the learned District & Sessions Judge, New Delhi District, Patiala House Court, Delhi on 4th April, 2016.
