The petitioner has filed the present petition impugning an order dated 31.05.2018 passed by the National Green Tribunal (NGT), New Delhi in Original Application No. 123/2018 captioned Tribunal on its own Motion v. State of of Uttarkhand & Ors. The learned counsel appearing for the respondents states that the said order has already been set aside by the Supreme Court by an order dated 14.06.2018 passed in Civil Appeal No. 5837/2018 captioned Reckitt Benckiser India Pvt. Ltd. v. State of Uttarakhand & Ors. and the petitioner therein has been directed to appear before the NGT. It is also pointed out that the Supreme Court has set aside the order qua the petitioners therein.

Mr Bansal, the learned Senior Counsel appearing for the petitioner

also states that the in view of the said order, the petitioner shall have to approach the NGT.

In view of the above, the impugned order dated 31.05.2018 is set aside. The petitioner is directed to appear before NGT for further proceedings.
