In this suit for specific performance parties have entered into a written settlement agreement before the Delhi High Court Mediation and Conciliation Centre on 28.10.2015.

The written settlement agreement signed by the parties falls within the scope of Order 23 Rule 3 CPC and, therefore, this suit is disposed of by passing a conditional/preliminary decree as per the terms as stated in the settlement agreement dated 28.10.2015. 2.

The Suit is accordingly disposed of and settlement agreement dated 28.10.2015 will form part of the decree. Parties are left to bear their own costs.
