% 18.01.2018 After some hearing, the learned counsel for the petitioner submits that he may be allowed to withdraw the present petition and instead move a fresh application under Order 12 Rule 6 of the Code of Civil Procedure, 1908 (CPC) referring to the additional grounds which have been pleaded in the main petition here to pray for a judgment on admissions. The learned counsel for respondent no.2 submits no objection to the liberty being granted subject to all defences available to the opposite party, there being no appearance on behalf of respondent No.1.
The petition is dismissed as withdrawn with liberty as prayed, granted.
