% 28.09.2018 Matter listed today again on the office noting despite it was disposed of on 09.05.2018 on the basis though defendant No.2 has been deleted from the array of parties yet, the affidavit of defendant No.2 was filed along with IA No.6435/2018 under Order XXIII Rule 3 CPC.

Learned counsel appearing for plaintiff submitted the matter was compromised and they had filed the affidavit of defendant No.1 and it was only by way of abundant caution the affidavit of defendant No.2 was also annexed with the compromise IA, though there was no need for it.
