% 26.02.2018 Learned counsel for State points out that although a status report had been filed by the State stating that offence under Sections 376/511 of the IPC will be pressed against the petitioner yet the charge sheet has now been filed under Section 354/354B/323/34 of the PC. The next date fixed before the Trial Court is 16.3.2018 for consideration of charge.

Learned counsel for petitioner points out that statement of Komal (daughter of respondent no.2) has not been considered by the Investigation officer in the correct perspective. It has also not been considered that there has been a delay in the registration of the FIR. At this stage, learned counsel for petitioner submits that he will

withdraw this petition.

Petition dismissed as withdrawn.

Liberty is granted to the petitioner to address his submissions before the concerned trial Court at the time when arguments are addressed on charge.
