Status report has been handed over which is taken on record. 4.
By this petition, the petitioner seeks parole on the ground that he has to file Special Leave Petition and also to maintain social ties. 5.
As per the status report, the petitioner has been convicted for offence punishable under Section 302 IPC which judgment of conviction and order of sentence has been upheld by this Court in Crl.A.No.940/2015 vide order dated 20th March, 2018. As per the status report though the apprehension has been expressed that there is a possibility of jumping the parole however it is clarified that the petitioner is a permanent resident of Village Turkadiya, PS-Dehat Kotwali, Distt.-Gonda, UP. The petitioner has five brothers who are W.P.(CRL) 1905/2018
well-settled with 10 bihgas land for farming in the village. It is thus apparent that the petitioner has roots in the society. As per the nominal roll, the petitioner has been in continuous custody since 12th July, 2013. Since the petitioner has been in continuous custody for the last almost five years, the unsatisfactory conduct was dated 3rd October, 2016 and for the last one year there is no misconduct in the jail, this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of 4 weeks on his furnishing a personal bond in the sum of ₹25,000/- with two surety bonds of the like amount to the satisfaction of the learned Trial Court/CMM concerned further subject to the condition that one of the surety bond would be a family member of the petitioner. 6.
Petition is disposed of.
