Alongwith the application, a settlement agreement arrived at between the parties before the learned Mediator, Mediation Centre, Rohini District Courts, Delhi on 24.09.2018 is placed on record. Ms.Toral Banerjee, learned counsel for the appellant and Mr. Anil Dagar, learned counsel for the respondent confirm the mediation settlement. 2.

Ms. Banerjee, learned counsel for the appellant seeks permission to withdraw the appeal.

In the circumstances, the appeal along with the application being CM No.25134/2018 (stay) is dismissed as withdrawn. The parties shall remain bound by the settlement dated 24.09.2018. 4.

In view of the above, the application being CM No.47638/2018 is disposed of.
