At joint requests of the parties, the petition is taken up for final disposal.
The petitioner has been granted Furlough by the State vide order dated 15.01.2018 for a period of three weeks from the date of his release. He has been unable to enjoy the liberty so granted since he is unable to comply with the first condition of furnishing two sureties in the sum of Rs.10,000/- each along with a personal bond in the like amount to the satisfaction of the Jail Superintendent concerned. No Status Report has been
filed by the State. However, Ms. Kamna Vohra, the learned Additional Standing Counsel for the State states upon instructions that the address of the petitioner has been verified. His father has since passed away and his ill mother is unable to travel to Delhi. His siblings are also incapable to come to Delhi and/or stand surety for the petitioner. The petitioner is ready and willing to deposit the amount as a ready surety instead of two sureties of Rs.10,000/- each.
The Court is of the view that in the circumstances obtaining apropos the petitioner, the relief sought by him should be granted. Accordingly, the condition is modified. The petitioner shall be released on his depositing an amount of Rs.10,000/- along with a personal bond in the like amount to the satisfaction of the Jail Superintendent concerned. Other conditions of the order granting Furlough dated 15.01.2018 will remain unaltered. With the above directions the writ petition is disposed off. A copy of this order be given dasti to the learned counsel for the parties.
