1. The present petition has been filed under Section 438 of the Cr.P.C in case of FIR No. 172/2018 registered under Section 420 IPC at Police Station Mukherjee Nagar.
2. Learned counsel for the petitioner has submitted that a false case has been lodged against the petitioner and he has been falsely implicated. Moreso, it is a counter blast to the FIR lodged by the daughter of the petitioner against the complainant registered under Section 354/506/341 IPC. It is further submitted that a disability certificate
was issued to the petitioner in 1971 by the Civil Surgeon, Jhajjar, Haryana after he suffered paralysis. It is added that by 2016 he recovered and a driving licence was issued to him.
3. Ms. Meenakshi Chauhan, Learned APP for the State appears on advance notice and furnished the status report and opposed the bail application.
4. Perusal of the record shows that in the driving licence, passport and other documents submitted to the Social Welfare Department, different dates of birth have been given. The documents are under verification. The petitioner has failed to join investigation and in the circumstances custodial interrogation of the petitioner would be necessary for completion of investigation.
