% 22.09.2016 IA No.11723/2016 (O.23 Rule 1 CPC) in CS(COMM) 604/2016 1.

The parties have been referred to Delhi High Court Mediation and Conciliation Centre. They entered into a settlement agreement on 16.08.2016, in the wake of which the plaintiff has moved the present application under Order 23 Rule 1 CPC seeking to withdraw the suit. By way of application the plaintiff also prays for refund of the court fees in the sum of Rs.7,55,700/- which have been paid, referring to Section 16 of the Court Fees Act, 1870 read with Section 89 of the Code of Civil Procedure, 1908 read with Section 151 CPC.

Having regard to the settlement arrived at through mediation, the prayer for withdrawal of the suit is granted. The suit is dismissed as withdrawn. All pending applications also stand disposed of. 3.

The Registry shall issue the necessary certificate for refund of court fees. The Collector shall refund the court fees to the plaintiff. R.K.GAUBA, J.
