O R D E R

% 23.09.2016 By this petition, the petitioner seeks quashing of FIR No.119/2012 under Section 498A IPC was registered at PS CAW Cell, Nanakpura on the complaint of respondent No.2 and proceedings pursuant thereto as the parties have settled the matter.

Learned APP for the State submits that in the above noted FIR the petitioner is only accused and respondent No.2 is only complainant/victim. Respondent No.2 is present in Court and is identified by her counsel. She states that she has settled the matter with the petitioner before Mediation Cell, Dwarka Court and in terms whereof divorce by mutual consent between the parties have been granted and the petitioner has already handed over title documents of property bearing No.M-290, Ground Floor, measuring 60 sq.yds. back side portion, M Block, Hari Nagar, New Delhi

and she does not have any claim whatsoever against the petitioner towards stridhan, maintenance, permanent alimony etc. The petitioner who is present in Court and is identified by learned counsel affirms the statement of respondent No.2 and states that he will abide by the terms of settlement. In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.119/2012 under Section 498A IPC was registered at PS CAW Cell, Nanakpura, Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

The petition is disposed of. Order dasti.
