% 06.09.2016 On the complaint of respondent no.2, the present FIR No.101/2009 under Sections 419/420/468/471/506/120B IPC was registered at police station Barakhamba Road.
Dispute arose between respondent no.2 and petitioners in respect of property deal of property bearing Flat No.306, Celebrity Suite, Palam Vihar, Gurgaon, Haryana. It is alleged in the FIR that petitioner no.2, who is wife of petitioner no.1, impersonated as Ms. Manju Malik and sold the said property to respondent no.2 for a sale consideration of `12,86,082/-. However, petitioners did not come forward for getting the property papers registered. Respondent no.2 and petitioners
have now settled their disputes vide Memorandum of Understanding dated 13th May, 2016.
Respondent no.2 is present in Court and has been identified by SI Naveen Dahiya PS Barakhamba Road. Respondent no.2 submits that matter has been settled with the petitioners and they have returned him the entire sale consideration taken by them, therefore, he is not willing to pursue the present FIR any further. It is noted that investigations are still pending.
Keeping in mind the fact that the disputes which have civil flavour, have been settled between the parties, in the interest of justice, the present FIR No.101/2009 under Sections 419/420/468/471/506/120B IPC registered at police station Barakhamba Road is quashed. Writ petition is disposed of in the above terms. A.K. PATHAK, J.
