The present application has been filed under Section 438 of Code of Criminal Procedure read with Section 482 of Cr.P.C on behalf of the petitioner in case FIR No.568 of 2017 registered under Section 379/34 at Police Station, Maurya Enclave.

Learned counsel for the petitioner contended that the petitioner is a young boy of 18 years and has been falsely implicated by the police officers. He further contended that no notice has been served on him; that the custodial interrogation of the petitioner is not required and he is ready to join the investigation as and when required by the investigating agency.

Learned counsel for the State who appeared on advance notice submits that TIP of the applicant is to be conducted, stolen articles are yet to be recovered.

From the perusal of the record it transpires that non-bailable warrant were issued against the petitioner by ACMM, Rohini Courts as the petitioner is absconding, recovery is to be effected for which custodial interrogation is required.
