BAIL APPLN. 1398/2018 The present bail application under Section 439 of Code of Criminal Procedure, 1973 (in short "Cr.P.C.") for grant of bail has been filed on behalf of the petitioner against whom FIR No.546/2017 under Sections 363/376D/344/328 IPC and POCSO Act registered at Police Station Jaitpur on the allegations of the prosecutrix that she had been kidnapped, sedated and raped.
The learned APP has argued that a minor girl is aged about 17 years was abducted by the petitioner/applicant living in the neighbourhood of the said victim and victim was dragged by the petitioner/applicant into a car in which three other accused were also present and the victim was sedated and
taken to room where she was repeatedly raped. The statement of the prosecutrix had been recorded under Section 164 of the Code of Criminal Procedure. The present bail application on behalf of the applicant, Ms. Nusrat Khan has been filed on the grounds that she is a woman and in the family way and is 8 months pregnant. The perusal of the record shows that there are specific allegations by the prosecutrix naming the applicant, Ms. Nusrat Khan which are of serious nature. Keeping in view the facts and circumstances of the present case, no ground for bail is made out.
The bail application is dismissed.
