Present petition has been filed under Article 226 of Constitution of India read with Section 482 of Code of Criminal Procedure for issuance of a writ of Habeas Corpus with a direction to respondents No. 1 to 3 to produce Smt. Pooja Chauhan, wife of the petitioner who has been illegally detained by respondents No. 4 and 5. 2.

Learned counsel for the petitioner submits that the marriage between the petitioner and Pooja Chauha was solemnized at Arya Samaj

Mandir, Himgiri Enclave on 20.08.2014. Copy of the marriage certificate has been annexed along with the petition. In support of proof of age of Pooja Chauhan, Class X Marksheet of Pooja Chauhan has also been placed on record.

Pooja Chauhan has been produced in court by the concerned SHO. Pooja Chauhan submits that she has married the petitioner out of her own free will without any pressure, fear or coercion. She further submits that she would like to reside with the petitioner. 4.

Having regard to the submissions made and stand taken by Pooja Chauhan, we allow the present petition. Pooja Chauhan would be free to join the company of her husband.

Petitioner also prays for police protection for himself and his family members and submits that the family members of the Pooja Chauhan are continuously extending threats to them. We direct the concerned SHO to provide necessary protection to the petitioner and his family members.

Accordingly, present writ petition stands disposed of. CM APPLN. No. 11446/2018 (for Direction) In view of the order passed in the writ petition, the present application stands disposed of.
