Mr. Pramod Kumar, Advocate versus THE STATE (GOVT. OF NCT OF DELHI) ..... Respondent Through:

Ms. Manjeet Arya, Additional Public Prosecutor for the State.

CORAM:

HON'BLE MR. JUSTICE A. K. CHAWLA

O R D E R

% 20.06.2018 Verification report is sought to place on record. It is taken on record.

Interim bail is sought in the face of the allegation of recovery of a girl labour child aged about sixteen-and-half years from a house. The applicant is said to be running the Placement Agency for providing the minor children. Despite persistent query as to the other material for the applicant running a Placement Agency, and, possibly thereby, having trafficked other minor children, learned Additional Public Prosecutor for the State has been at pains to point out but for stating that the investigations are still in progress. The girl child was allegedly recovered in a raid conducted by SDM on 24.04.2018 and the FIR came to be registered on 25.04.2018.

As for the prayer in the application in hand, interim bail is sought to attend some marriage ceremony. It appears to be quite strange. As per the verification report, son of the applicant has been living with the girl, also has a child aged about one-and-half years. Even a child having been born from such matrimonial relation, the ground for seeking bail to perform matrimonial event is not justifiable to entertain the application.

Keeping in view the totality of facts and circumstances, the Investigating Officer is directing to conclude the investigations and file the Challan within a period of 15 days from today. On the challan being so filed, applicant would be entitled to file a fresh application which shall be considered by the concerned trial court on its own merits.

The application stands disposed of accordingly. A. K. CHAWLA, J (VACATION JUDGE) JUNE 20, 2018 pkb
