Bail Appln. Nos. 1431/2018 By the present application, the petitioner seeks anticipatory bail in case FIR No. 60/2017 under Sections 420/467/468/471/120-B/34/174-A IPC retgistered at Police Station - Begumpura.
Learned counsel for the petitioner submits that the parties have arrived at a settlement in terms of the Compromise Deed dated 11.06.2018 and agreed to pay Rs.92,50,000/- as per the said Compromise Deed. Mr. Surjeet Singh, Authorised Representative of the complainant company/ M/s.IndoStar Capital Finance Limited is present in Court today
and identified by the counsel, received a Demand Draft No.030653 for Rs.40,00,000/- dated 11.06.2018 in favour of Indostar Capital Finance Ltd. drawn on HDFC Bank, Rajauri Garden alongwith 24 Post Dated Cheques for Rs.2,18,750/- each.
Statements of the parties have been recorded separately. In view the of settlement arrived at between the parties, I find it appropriate to grant anticipatory bail to the petitioner. In case of arrest, SHO/IO is directed to release the petitioner on her furnishing a personal bond in the sum of Rs.50,000/- with one surety of like amount to their satisfaction. The petitioner is directed not to leave the territorial jurisdiction of Delhi NCR without prior permission of the Trial Court and shall join the investigation as and when directed by the Investigating Officer. Application stands disposed of.
