This is an application under Order XXIII Rule 1 of CPC seeking withdrawal of the suit with liberty to avail of remedies. 2.

The application consists of various allegations and facts in reference to the minutes of the meeting dated 28th August, 2018 of the Export Promotion Council i.e. Defendant No.2. This Court is not going into any of the allegations made in the application and the same are deemed to be struck of from the application under Order XXIII Rule 1 of CPC. 3.

This Court is simply directing the dismissal of the suit in view of the fact that the plaintiff wishes to withdraw the same. 4.

Suit is dismissed as withdrawn.

Since the suit is at the inception stage, no order as to cost. 6.

Liberty is being sought by Mr. Rahul Gupta, counsel for the Plaintiff

to file a fresh suit if there is fresh cause of action. No such liberty is required to be granted.
