The petitioner has preferred the present writ petition to seek a writ of habeas corpus for production of his sister- Rabiya. Rabiya is married to one Yunus Saifi. The petitioner has disclosed that Rabiya was ill treated in her matrimonial home. She has one son out of the said wedlock. Rabiya went missing from her matrimonial home on 3.06.2018. Rabiya has been produced today in Court. She states that she left her matrimonial home since she was being subjected to physical violence by her husband and in-laws. She states that she wishes to return with the petitioner to her parental home. The petitioner who is present in Court has assured the
Court that Rabiya would be looked after properly and given full protection in her parental home. He has also undertaken that Rabiya shall not be forced to go back to her matrimonial home against her wish. Accordingly, Rabiya may accompany the petitioner and go with him to her parental home from the Court itself.
SHO, PS Jaitpur is directed to ensure the safe passage of both the petitioner and her sister Rabiya. The personal belongings of Rabiya are still lying in her matrimonial home. The SHO, PS Jaitpur shall ensure that the same are handed over to Rabiya by her husband and in laws without any acrimony. In case, any complaints are received from the petitioner or his parents or Rabiya about any threats or violence by the husband of Rabiya or his family members, the same shall be seriously looked into by the SHO, PS Jaitpur and appropriately actioned.
