The petitioner seeks anticipatory bail under Section 438 Cr. P.C. in case FIR No. 582/2016 dated 04.08.2016 registered under Sections 376/506/34 IPC registered at Police Station Khajuri Khas. Status report is on record.

I have also heard counsel for the parties and examined the file. Petitioner's counsel urged that false allegations have been levelled by the prosecutrix against the petitioner for commission of rape. The petitioner and the prosecutrix were having affairs prior to the lodging of the FIR. The delay in lodging the FIR has not been explained.

3. On perusal of the statement of the prosecutrix, it reveals that BAIL APPL.556/2017

there are serious allegations of commission of rape against the petitioner and co-accused Mohit, on some dates. 4.

It is relevant to note that Bail Application moved by the coaccused Mohit has been dismissed as withdrawn by the Coordinate Bench of this Court by an order dated 03.03.2017. 5.

Considering the gravity of the offence and serious allegations against the petitioner, no sufficient ground for grant of anticipatory bail. The Bail application is dismissed.
