The parties have filed joint application CM 3719/2016 which is signed by both the parties and is also supported by their affidavits. 2.

Learned counsel for the petitioner submits that the parties have again resolved their disputes through mediation vide settlement agreement dated 9th September, 2015 and in terms of the said settlement, first motion for divorce has been allowed by the learned Principal Judge, Family courts on 10th August, 2015 and the second motion of divorce is agreed to be filed in February 2016.

Learned counsel for the petitioner seeks permission to withdraw this petition in view of the agreement dated 9th July, 2015. 3.

CM 3719/2016 is allowed and Cont.Cas(C) 791/2013 is disposed of in terms of the settlement between the parties.
