O R D E R
% 04.07.2018 The petitioner seeks interim bail for a month to attend to his ailing mother, who has to undergo a CAG Procedure i.e. Coronary Angiography. She was to be admitted to B.L. Kapoor Hospital on 18.06.2018, however, she was found to be running temperature on 19.06.2018, hence the procedure has been deferred to another date i.e. 09.07.2018. This aspect has been verified by the Police in the Status Report, which has been handed over today, by the learned counsel for the State. The petitioner's two sisters are living in their marital homes and his two brothers are stated to be not in a condition to look after their mother.
Learned counsel for the State submits that the petitioner is also involved in another case of a similar nature, however, he has been granted bail in the same.
Looking into the medical exigencies of the mother, who is a senior
citizen, the petitioner is enlarged on bail for a month from the date of his release on furnishing a personal bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Trial Court concerned, subject to the following conditions:- (i) the petitioner will regularly appear on each and every date of hearing to be fixed by the Court concerned;
(ii) the petitioner will not try to influence, contact or meet the complainant and prosecution witnesses in any manner; (iii) the petitioner will not leave the country without prior permission of the Court and the passport, if any, shall be deposited with the Trial Court concerned; and (iv) in case of change of his new address or contact number, the petitioner will promptly intimate to the SHO/IO of the case and intimate the Trial Court also;
(v) the petitioner shall surrender before the jail authorities at the expiry of the period of interim bail.
The petition stands disposed off in the above terms. Nothing stated in this order shall be deemed to be an adjudication on the merits of the case.
The Registry is directed to send a copy of this order to the Jail Superintendent concerned for information.
A copy of this order be given dasti to the learned counsel for the parties under the signatures of the Court Master. NAJMI WAZIRI, J JULY 04, 2018 rd
