BAIL APPLN. 1455/2018 1.

Learned counsel for the petitioner submits that the petitioner has been incorrectly declared as a proclaimed offender as he was never served with any notice or warrants of the Court from the Court as he was not residing at the said address.

Learned counsel for the petitioner under instructions seek leave to withdraw the petition with liberty to surrender and approach the Trial Court for grant of regular bail as also to seek recall of proceedings under Section 82 of the Cr.P.C.

Learned counsel for petitioner submits that the petitioner shall surrender within one week before the Trial Court. 4.

In view of the above, the petition is dismissed as withdrawn with liberty to the petitioner to surrender and approach the Trial Court for grant of regular bail.

In the peculiar facts and circumstances of the case, the Trial Court is directed to consider the application for grant of bail on the day the petitioner surrenders. In case the petitioner surrenders within one week from today, till the application of the petitioner for grant of regular bail is considered and decided by the Trial Court, the petitioner shall not be arrested.

Petition is disposed of in the above terms.
