Both insurance company and the claimant challenged the award

of the MACT Karkardooma Court dated 06/01/2015 by way of MAC APP No. 300/2015 filed by the Insurance Company and MAC APP No. 596/2015 filed by the claimant.

The matter has been mutually settled between the parties. It is amicably agreed between the parties that the Insurance Company will pay a lump-sum amount of Rs.3,75,000/- (Rupees Three Lakhs Seventy Five thousand Only) to the claimant i.e. Shri Anil Kumar as full and final settlement over and above the award of the Ld tribunal. Insurance Company has deposited entire awarded amount alongwith upto date interest accrued thereon before UCO bank, Delhi High Court Branch in compliance of the order dated 27/03/2015. It is pointed out by the Ld. counsel for the claimant that the only 50% of the awarded amount has been released and further requested that rest of the 50% amount lying deposited in the form of FDR with UCO Bank, Delhi High Court Branch may be released in favour of the claimant.

In view of the settlement arrived at between the parties, the Insurance Company is directed to deposit Rs.3,75,000/- within four weeks from today before the Delhi High Court Legal Services Committee (DHCLSC) failing which it shall carry interest @ 7.5% per annum. The DHCLSC shall then release the amount to the claimant subject to the fulfilment of requisite formalities. Further, 50% of the amount lying deposited in the form of FDR with UCO Bank, Delhi High Court Branch be released to the claimant in terms of the award of the learned Tribunal.

The Registrar General shall release the statutory amount of Rs.

25000/- along with interest, if any, to the Insurance Company. Consequently, the appeals stand disposed of accordingly. 5.
