% 26.10.2016 The petitioner has preferred the present anticipatory bail application under Section 438 Cr PC apprehending arrest in case FIR No.325/2016 under Section 406/498A/34 IPC and section 4 of Dowry Prohibition Act at PS Prashant Vihar. The petitioner is the husband of the complainant. The submission of learned counsel for the petitioner is that the petitioner has already joined the investigation. So far as the dowry articles are concerned, learned counsel for the petitioner has pointed out that while leaving the matrimonial home, the complainant had acknowledged receipt of various dowry articles including her jewellery and the jewellery of the minor girl child. He has also drawn the attention of the court to the pleadings in

the divorce petition made by the petitioner and the response thereto given by the complainant, wherein also she has acknowledged the receipt of several dowry articles including jewellery.

Mr. Katyal submits that the charge sheet is ready for being filed. This implies that investigation is more or less complete and there would be no need for custodial interrogation of the petitioner. In the aforesaid circumstances, the petition is allowed. In case of his arrest, the petitioner shall be released on bail upon furnishing a personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the arresting officer. This is further subject to the condition that the petitioner shall join the investigation as and when called upon by the I.O. The petition stands disposed of in the aforesaid terms. At this stage, the complainant, who is present in court, states that she is interested in exploring the possibility of a mediated settlement. Learned counsel for the petitioner, on instructions, is also agreeable for the same.

Accordingly, let the parties appear before the Delhi High Court Mediation & Conciliation Centre on 03.11.2016 at 4:00 p.m. The Mediation Centre is requested to nominate an experienced mediator dealing with matrimonial disputes. The mediation report shall be sent to the court dealing with the divorce proceedings.
