Respondent no.3 is present in Court and he has brought cash amounting to ₹5,20,000/-. However, this Court does not consider it apposite to permit respondent no.3 to make any payment in cash. He has, accordingly, issued a cheque for a sum of ₹5,20,000/- being cheque no.043377 dated 23.08.2019, drawn on AXIS Bank Ltd. Yamuna Vihar, New Delhi-110053. He states that the said cheque has been accepted by the petitioner as payment of the remaining balance payable as per the settlement as recorded between the parties. The petitioner shall deposit the said cheque on 26.08.2019, thus enabling respondent no.3 to deposit the cash (which he has brought to this Court) to be deposited in his bank account.

The learned counsel appearing for the petitioner states that on receipt of the cheque, the petitioner's grievance does not survive, therefore, she seeks to withdraw the present petition with liberty to file afresh if a cause so arises.

The petition is dismissed as withdrawn with the aforesaid liberty. The pending application is disposed of.

The petitioner and respondent no.3 shall sign a copy of this order as acknowledgement of the statements recorded herein. 5.
