% 03.07.2018 Crl.M.A. No. 11624/2018 (Exemption) Allowed, subject to all just exceptions.

W.P.(CRL) 1879/2018 By this petition, the petitioner seeks parole on the ground of marriage of his step-daughter which is fixed for 7th July, 2018. On a notice being issued status report and nominal roll have been handed over which are taken on record.

As per the status report the petitioner was convicted for offences punishable under Sections 376 and 377 IPC committed on the step-daughter whose marriage is now to be performed. Further, the petitioner has been granted three furloughs in the year 2018 and if the petitioner was required at W.P.(CRL) 1879/2018

the time of marriage he could have availed furlough at the time of marriage. Considering the facts noted in the status report this Court finds no ground to grant parole to the petitioner.

Petition is dismissed.
