% 25.05.2016 Crl.M.A. 8636/2016 (Exemption) Application is allowed subject to just exceptions. Bail Appln. 1089/2016 The present application has been moved on behalf of the petitioner under Section 439 Cr.P.C. for the grant of interim bail in FIR No.497/2012, under Sections 302/307/452/365/342/368/395/397/ 34/120B IPC, Police Station Mehrauli on the ground of ailment and taking care of his wife.
The interim bail of the petitioner has been declined by the Trial Court vide order dated 22.03.2016 on the ground that the sons of the petitioner are available to look after their mother. Undisputedly, apart from the present petitioner, one bail application was moved for coaccused Sukhdev Singh Namdhari who remained on interim bail for long period and ultimately it came to an end only after the dismissal
of regular bail application by this Court.
Similar was the case of another co-accused Narender Kumar Ahlawat who also remained on interim bail for about three years and ultimately his bail application was dismissed by this Court.
In the present case, the bail applications of the petitioner moved before the Trial Court were dismissed on 22.03.2016 and 08.04.2016. During the course of arguments, counsel for the petitioner wishes to withdraw the present application.
Consequently, the present application is dismissed as withdrawn. P.S.TEJI, J MAY 25, 2016 dd
