ORDER
% 12.10.2017 Transfer, in exercise of powers under Section 24 of the Code of Civil Procedure, 1908 (CPC), is sought of CS No.517406/2016 and Counter Claim No.3/2016 therein and pending in the Court of Shri Vijay Shankar, Additional District Judge, Dwarka Courts, Delhi to this Court on the ground of Mr. Deepak Jakhar, Advocate, son of the respondent practising in the District Courts, having beaten up the petitioner when he appeared in the suit in the Dwarka Courts.
Notice of the petition was ordered to be issued and the counsel for the respondent appears.
The counsel for the petitioner has stated that the petitioner feels more safe in appearing in this Court rather than in the Dwarka Courts. No transfer on this ground can be permitted. The counsel for the respondent has stated that the petitioner is facing prosecution in five other cases in Dwarka Courts. Though the counsel for the respondent denies the TR.P.(C.) 54/2017 page lof 2 Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.
averments on which transfer is sought but on enquiry, it is informed that Mr. Deepak Jakhar, Advocate is present in Court. Mr. Deepak Jakhar, Advocate on enquiry states that he practices in all District Courts as well as in this Court and on my request has assured that no untoward incident attributable to him shall happen qua the petitioner.
I have no reason to not believe the said assurance of an Advocate of this Court.
The petition is dismissed.
