% 06.07.2018 Crl. M.A. no. 11586/2018 (exemption) Allowed, subject to all just exceptions.

Application is disposed of.

Bail Appln.1460/2018 Petitioner seeks interim bail for filing SLP before the Supreme Court against the judgment dated 04.01.2018 passed in Crl.A.911/2016. Vide order dated 11.06.2018, petitioner has already been granted parole by a bench of coordinate jurisdiction in W.P.(Crl.) 1212/2018. Petitioner is also involved in Crl.A.1150/2016. He filed an application for interim suspension of sentence in the said appeal on the ground that he intends to file SLP in Supreme Court.

The Division Bench of this Court vide order dated 30.05.2018 passed in Crl.M.(Bail) 77/2018 has ordered for release of petitioner for a period of 15 days starting from the date of his release, on

certain conditions as stipulated in the said order. Accordingly, I do not find any justification to decline the relief of interim bail in this case as the same would amount to nullifying the orders passed in W.P.(Crl.) 1212/2018 and Crl.A. 1150/2016. For the foregoing reasons, petitioner is granted interim bail of 15 days from the date of his release, subject to his completing following conditions: i. The petitioner will furnish a personal bond and one surety either of his father or of his mother in the sum of `20,000/- to the satisfaction of the trial Court.

ii. The petitioner shall give his present correct address along with the mobile number on which he can be contacted, to the Investigating Officer as well as the Jail Superintendent and promptly inform them of any change.

The mobile phone will be kept switched on throughout the period of suspension of sentence. iii. The petitioner will not attempt to contact any of the witnesses or the family of the victim.

iv. The petitioner will promptly surrender on the expiry of aforementioned period of 15 days from the date of his release. v. The petitioner will mark his attendance before the SHO of the police station Vasant Kunj (North) twice a week i.e. on Monday and Thursday at 10 a.m.

Bail application is disposed of in the above terms. Dasti. A.K. PATHAK, J.
