% 02.08.2016 After some arguments, learned counsel for the petitioner wishes to withdraw the present writ petition with liberty to file an appropriate proceeding in accordance with law to challenge the recommendation of the Sub-Divisional Magistrate, Punjabi Bagh dated 23rd October, 2015.

With the aforesaid liberty, present writ petition and the application are dismissed as withdrawn. This Court, however, clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open.
