Thus no leave to appeal is required to be sought by the petitioner in terms of the decision of the Supreme Court reported as 2018 SCC online 1941 Mallikarjun Kodagali Vs. State Of Karnataka. The present leave to appeal petition be treated as a criminal appeal. CRL.A._______/2019 (Registry to re-number the CRL.L.P.) Learned counsel for the appellant has taken this Court through the statement of the prosecutrix PW-4.

Notice. Learned APP for the State accepts notice. Notice be now issued to respondent No.2 and 3 on the appellant taking steps through ordinary and dasti process, registered AD and speed post returnable on 27th September, 2019.
