% 31.05.2016 The present is an appeal under Article 226 of the Constitution of India read with Section 482 of Code of Criminal Procedure, 1973 seeking a direction to the competent authority to release the petitioner on parole on medical grounds, that his health condition is deteriorating because of serious injuries and fractures sustained in a road accident.
It is noticed that a medical report dated 30.05.2016 qua the petitioner has been furnished by the Office of the Senior Medical Officer, Central Jail-02, Tihar, New Delhi, wherein it is opined that the general condition of the petitioner is stable.
In view of the foregoing, Mr. Kaushik, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to approach the competent authority with a representation seeking parole, afresh, at an appropriate stage, in accordance with law. Leave and liberty granted.
The writ petition is dismissed as withdrawn and disposed of accordingly. SIDDHARTH MRIDUL, J
