% 14.03.2019 In the petition the prayer of the petitioners is limited to the extent of providing protection from respondent No.4.

Petitioners are present in person. This is the third date when counsel for the petitioners is not appearing. Hence this Court heard the petitioners and respondent No.4 besides the learned Additional Standing Counsel for the State.

Respondent No.4 and the erstwhile respondent No.5 are the sister-inlaw and brother of petitioner No.2; respondent No.5 having since died. The dispute between the parties is admittedly due to the distribution of the property and according to the petitioners there is a continuous harassment on this count to the respondent No. 4. Civil suits have been filed by both W.P.(CRL) 943/2017

parties which are pending consideration. On repeated queries to the petitioners as to what kind of harassment is caused it is stated that there is generally a verbal altercation between the parties. Thus, no cognizable offence appears to have been committed.

Consequently, the writ petition is disposed of directing the SHO concerned of PS Alipur to ensure peace, harmony and tranquillity in the area through beat staff. No further orders are called for. Petition is disposed of.
