Copy supplied to appearing counsel of defendant no.1 as it is stated that defendant no.2 is being deleted by way of the present IA. Learned counsel for defendant no.1 submits that he does not wish to file any reply to the present IA. Re-notify for consideration on this IA on next date of hearing. CS (OS) 259/2016 and IA No.6653/2016 u/O XXXIX R1&2 CPC moved by plaintiff Previous cost has been paid by learned counsel for defendant to learned counsel for plaintiff today in the court. Replication to the written statement of defendant no.1 has not been filed within the time granted by the court. Learned counsel for plaintiff seeks some more time to file the same and submits that Contd....2

Hence subject to payment of cost of Rs.2000/- to defendant no.1, last opportunity of four weeks is granted to plaintiff to file replication to the written statement of defendant no.1.

It is stated by learned counsel for defendant no.1 that contents of his written statement be read as reply to the present IA. Thus pleadings on this IA are complete.
