Without going into the same, we dispose of the application, in view of the statement made by learned counsel for the petitioner/nonapplicant that he would be arguing the appeal filed before the DRAT today. The non-applicant/petitioner would be bound by the said statement. Learned counsel for the Indian Overseas Bank would be at liberty to point out the said position and the order passed today to the Chairman, DRAT, when the appeal is taken up for hearing.
