W.P.(C) 6668/2018 & CMs 25386/2018 (stay) The learned counsel for the respondent No.1, who appears on advance notice, submits that the impugned order is appealable under the Delhi Municipal Corporation Act, 1957.

The learned counsel for the petitioner submits that the appeal could not be filed as the appellate authority is not holding the Court due to summer vacation.

Having perused the Impugned Order as also the photographs of the site annexed with the petition, the respondent No.1 is restrained from taking further action on the basis of the Impugned Order for a period of three weeks within which time the petitioner shall approach the appellate authority by way of an appropriate application. The appellate authority shall

consider such application on its own merits and not be influenced by any observation made by this Court in the present order. The petition is disposed of.

Copy of the order be given dasti under the signature of the Court Master.
