O R D E R

% 28.03.2017 It is submitted that petitioners and respondent no. 2 have settled their disputes amicably, vide a Settlement Agreement dated 7th March, 2017 (Annexure E), therefore, FIR No. 693/2016 under Sections 420/468/471/34 IPC registered at Police Station Saket, on the complaint of respondent no. 2 may be quashed.

It is submitted that disputes relate to changing the plan of the SIM card purchased by the respondent no. 2 from the petitioner no. 1.

Respondent no. 2 is present in Court along with his counsel and admits having settled the matter with the petitioners. He also admits having received the entire settled amount vide two cheques, photocopies whereof have been annexed with Annexure E.

Respondent no. 2 submits that cheques have already been encashed and he is not willing to pursue the FIR, in view of the settlement arrived at by him with the petitioners of his own own free will and without any undue force, coercion and pressure. Keeping in mind the fact that petitioners and respondent no. 2 have settled their disputes amicably and that respondent no. 2 is not willing to pursue the FIR any further, no fruitful purpose would be served to keep them entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No. 693/2016 under Sections 420/468/471/34 IPC registered at Police Station Saket and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous. Dasti.
