O R D E R

% 31.08.2016 Ms. Latika Chaoudhary, the learned counsel for respondent No. 2 submits, upon instructions, that by a Show Cause Notice dated 30th August, 2016, the petitioner has been asked why the ratio in the case of S.P. Aastha should not be made applicable to him and his claim be not computed in terms of the ratio in the aforesaid case, i.e, WP(C) 7102 of 2001 (decided on 04.12.2014 against which a LPA was preferred which was also dismissed on 20.05.2015). It has also been intimated to the petitioner that no recovery will be effected for excess payments made to him. A copy of the letter has been handed over to the learned counsel for the petitioner. The petition seeks re-fixation of the pension. It is now being done in terms of the aforesaid Show Cause Notice. Nothing survives in the petition. It is disposed off accordingly.

Should be petitioner feel aggrieved by any subsequent order, his right
