% 10.04.2017 By this petition, petitioner has prayed for quashing of FIR No. 464/15 under Sections 384/408 of the Indian Penal Code registered at police station Maya Puri on the complaint of respondent no.2. It is submitted that petitioner and respondent no.2 have settled their disputes amicably vide Settlement Agreement dated 5th April, 2016.

Respondent no.2 is present in Court and has been identified by SI Rajender Prasad of police station Maya Puri. She is widow of Late Sh. Deepak Bhardwaj. She has alleged in the FIR that petitioner is ex-employee of M/s. Delhi Apartments Pvt. Ltd. of which her husband-Late Sh. Deepak

Bhardwaj was Managing Director. After the death of her husband petitioner withheld the documents of the said company including certain blank papers containing signatures of Late Sh. Deepak Bhardwaj. When she asked the petitioner to return the documents he threatened that unless he is paid `2.5 crores, he would not return the documents.

Respondent no.2 submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion and has no objection in case the FIR is quashed in view of the settlement. She admits having received all the documents.

Petitioner is also present in Court and submits that all the documents, pertaining to the company and Late Sh. Deepak Bhardwaj, which were in his possession, have been returned by him to the respondent no.2 and now he has no document in his possession pertaining to the said company or Late Sh. Deepak Bhardwaj.

Keeping in mind that a settlement has been arrived at between the petitioner and respondent no.2, in the interest of justice, FIR No. 464/15 under Sections 384/408 IPC registered at police station Maya Puri and the consequent proceedings emanating therefrom are quashed.

Writ petition is disposed of. Miscellaneous application is disposed of as infructuous.
