% 17.05.2017 Vide order of 6th January, 2017, respondent was directed to decide petitioner's representation of 22nd January, 2016. Counsel for petitioner has handed over a copy of order of 20th April, 2017 vide which petitioner's representation has been decided. In view of aforesaid, this Court finds that this contempt petition has become infructuous and so, the date of 21st July, 2017 fixed in this petition is cancelled and the hearing is preoponed for today, as in the application filed by petitioner [C.M. 18774/2017] a direction is sought to restrain the respondent from acting upon Eviction Notice of 12th May, 2017, which has been annexed as Annexures P-2 to this application. Vide aforesaid Eviction Notice of 12th May, 2017, petitioner has been directed Cont. Cas (C) 257/2017

to close commercial activity within 48 hours and submit a reply. It is not in dispute that the reply to the Eviction Notice of 12th May, 2017 has been given by petitioner.

In the facts and circumstances of this Case, it is deemed appropriate to direct respondent not to act upon Eviction Notice of 12th May, 2017 for a week from today to enable the petitioner to have recourse to law against order of 20th April, 2017. With aforesaid directions, this petition and application are disposed of.
