O R D E R

% 29.03.2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.1380/2016, under Section 135 of Indian Electricity Act, 2003 registered at Police Station Mehrauli, New Delhi and all the proceedings emanating therefrom.

Learned counsel for the petitioner has submitted that the respondent No.2/BSES Rajdhani Power Ltd. filed a complaint against the petitioner, which resulted into registration of the aforesaid FIR. Counsel further submits that thereafter, the matter was amicably settled between the parties before the Lok Adalat for a total sum of Rs.1,28,663/- and the said amount has been paid by the petitioner to the respondent No.2 and nothing further remains to be adjudicated further between the parties. However, the present

FIR is coming as hurdle in the personal life of the petitioner and prays that the FIR and all proceedings arising therefrom may be quashed. Learned Standing Counsel for the respondent No.2/BSES admits the factum of amicable settlement with the petitioner before the Lok Adalat and submits that as per the said settlement the petitioner has deposited a sum of Rs.1,28,663/- with the respondent No.2 for which a No Objection Certificate (NOC) has also been issued to the petitioner and nothing remains to be due and payable by the petitioner and further submits that he has no objection if the FIR and all subsequent proceedings arising out of the same are quashed.

Looking into the above facts and circumstances since the dispute has been amicably settled between the parties before the Lok Adalat and the same has been acted upon between the parties and also that the petitioner has deposited the settled amount of Rs.1,28,663/- with the respondent No.2, to meet the ends of justice, I deem it appropriate to quash the FIR in question and all subsequent proceedings arising therefrom. Consequently, FIR No.1380/2016, under Section 135 of Indian Electricity Act, 2003 registered at Police Station Mehrauli, New Delhi and all the proceedings emanating therefrom are hereby quashed. The present petition is allowed and disposed of accordingly. Copy of this order be given dasti to the parties, as prayed. I.S.
