% 26.05.2016 Present writ petition has been filed seeking a direction to respondent No.2 to ensure that the petitioner's five representations dated 2nd August, 2014 with regard to Export Promotion Capital Goods Scheme (for short 'EPCGS') are decided by the Policy Relaxation Committee.

The admitted position is that one of the representations has become infructuous as an order in original has been passed on 27th April, 2016 directing the petitioner to pay Rs.1,46,00,000/- as penalty. To be fair to the petitioner, the said order has not been challenged in the present proceedings. However, the other four representations dated 2nd August, 2014 are stated to be still pending. Therefore, this Court disposes of the writ petition and applications by directing the respondent no.2 to decide the petitioner's

representations either himself or by an entity which is authorised under the scheme, in accordance with the law as expeditiously as possible preferably within a period of six weeks. This Court, however, clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open.
